What’s this “right of resistance”?

Kılıçdaroğlu has once again gone over the limits. The language he used and the mentality he presented while criticizing the President forestalled the matters he had criticized as a problem.


He was stating the following in the recent group meeting of CHP:


“We have to start a national independence war. There is a community, whose constitution had been suspended and whose parliament is under pressure. If this process goes on any longer, the nation’s right of resistance will be revealed….”


Every country has a political memory.


Some words, emphases, statements take a spot in this memory, and symbolize certain situations and attitudes.


Where does this “right of resistance”, which is clearly pointing at a nonpolitical situation, a state where political opportunities ran short, or at least to street demonstrations that were directed by an attempt, sit in our history as a word, where it had been used? Or, what does it represent?


Now, let us read the first sentence of the “beginning” of the 1961 Constitution, which had been prepared after the military coup in 1960:


“The Turkish Nation, which actualized the May 27, 1960 Revolution against a rulership, which lost its legitimacy after their attitudes and behaviors moved outside the Constitution and Law, by using their right of resistance….”


This sentence is one, which states that the 1960 military coup identifies the law,  confirms the military coup and the act of being able to stage a coup with the “right of resistance”.


The “right of resistance” is synonymous with “coup” and “the pursuit of coup legitimacy” in our political story.


That period’s main founding article is what registered this.


The council members and constitutional law professors, who formed this sentence, and CHP, who defended this mentality, are just a black mark in the national and political memory today.


Can Kılıçdaroğlu even hear what he is saying?


If Kılıçdaroğlu, who was around 18-years-old when the coup had been staged, doesn’t know of the 1961 Constitution’s preamble, then it’s a kind of disgrace. And even if he does, then it’s another kind of disgrace.


You might not like the Presidential system suggestion. You might even find it dangerous. You might be uncomfortable with AK Party’s dominant party model and Tayyip Erdoğan’s style. For every political move you object to, you can use your right to protest with ways within or outside the parliament.


Again, with political ways, you can force AK Party to act differently or to consent, and you can use the public opinion and the press for it. You can develop strategies, alliances in order to politically beat AK Party in the elections. However, you cannot attempt to make Turkey, or democracy, pay for your ineptness, chronic opposition imprisonment or depoliticism by pointing at “non-political ways”.


Kılıçdaroğlu says that the constitution has been suspended….


This is a meaningless claim…


He is speaking of a community under pressure….


This is also another meaningless claim…


Similar to 1960…


Today, there are many problems in Turkey from the point of separation of powers, freedom of press, judiciary-politics relations, and dominance of politics. There is a shortcoming of democracy and law. These are problems that have to be fixed and criticized.


However, none of these fulfills definitions like the suspension of constitution, or, dictatorship.


If he thinks it does, then Kılıçdaroğlu has to explain this to the nation with more suitable ways and examples and become the rulership, or, stop AK Party in the election.


If the constitution is being suspended via legislative and executive ways, then he has to apply to high courts, which are the referee for this.


He should bring strong, convincing, and even forcing, law amendments.


“A rulership, which lost its legitimacy following their attitudes and behaviors outside the Constitution and Law…” (According to what and who)


“Turkish Nation, who used it’s right of resistance…” (In other words, the Turkish military)…


He should never forget these statements….

And never use them again…
